Confession Vs Admission | Confession and admission are not same
Though the word 'confession' and 'statement' seems to be the same, they are different and have different functions.
1. If a person voluntarily acknowledges the existence or truth of a particular fact, that will be counted as an 'admission.' If a person acknowledges his guilt or the accused states against him is called 'confession.'
2. If the statement made by the party in a civil proceeding is called admission. Whether the statement is made by a party(charged with a crime) in a criminal proceeding is called confession.
3. Admission can be made by a party, legal representative, or agent, but the confession can be made only by the accused.
4. Admission can be in favor or disfavor to the party making it, but confession always goes against the party making it.
5. Retraction is not possible in case of admission, but retraction is possible in confession.
6. Confession is conclusive proof, whether admission is not conclusive but substantive evidence.
